I'm under the impression that this is just a creature that is not wanted on the site, and I don't mean to point fingers by saying that. I just have not had a single thread since the creature was approved that was not deemed non-canon and personally it takes a lot of time to try and write stories to fit the creature in without them being labeled non-canon. I had already felt bad about the way it was approved and offered to remove the creature at that time but it has continued to cause me problems in every thread where it appears. At this point I have no further interest in developing this creature because I'm under the impression it simply will not fit in to the standard that are being held.
Could I just have the 400 PBP I had to spend on the creature when it was approved back and apply for a different legendary mount?

Since you haven't used the Windwalker in a thread that is canon, you may as well have the 400 pbp back, yes. And feel free to have a do-over for your legendary mount, since this one was deemed not a mount.
